Appeals Court: SWEPCO Coal Plant Injunction Valid

LITTLE ROCK – A federal appeals court has upheld a ruling that ordered a halt to some work at a $2.1 billion coal-fired power plant in southwestern Arkansas.

The Thursday ruling by the 8th U.S. Circuit Court of Appeals affirms a decision from last October in which the Hempstead Hunting Club and other groups sought a temporary halt to discharge of dredge or fill material into wetlands.

The temporary injunction by U.S. District Judge William R. Wilson Jr. also blocked installation of a water intake structure at the bank of the Little River and stopped the utility from stringing transmission lines across the Little and Red rivers.

Southwestern Electric Power Co. appealed Wilson’s decision, which affected work on 8 acres of the 3,000-acre site. SWEPCO argued it would be harmed by the injunction.
